Visitec "New Zealand's Hardest Worker Win a Ute"

Terms and Conditions

By entering the Visitec "Win a Ute" competition, you are agreeing to the following terms and conditions:


1. STANDARD TERMS


1.1 Information on how to enter forms part of the terms of entry.


2. WHO CAN ENTER?


2.1 Subject to clause 2.2, entry is open to all residents aged 18 years and over of New Zealand via entry through participating stores.

2.2 Employees and their immediate families of Visitec (NZ) Limited and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.


3. HOW TO ENTER


3.1 The competition commences on Monday 23rd February 2009 at 9.00am NZ time and concludes on Friday 31st May 2009 at 5.30pm NZ time ("the Competition Period").

3.2 In order to enter, customers must purchase a Visitec Garment displaying the Competition Sticker from participating stores, customers must then affix their receipt as proof of purchase to the completed entry form and place the receipt and entry form into the nominated entry box located in participating stores.

3.3 Entries must be received by Friday 31st May 2009 at 5.30pm NZ.

3.4 The entry must:

(a) be completed on the original entry form available in store.
(b) have the original receipt as proof of purchase affixed to completed entry form.

3.5 Entry details remain the property of the Promoter and will not be returned to the entrant. The winner agrees to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media nation-wide and the winners will not be entitled to any fee for such use.


4. PRIZES

4.1 There will be one (1) winner of the competition. The winner will receive the following prize:

- 1x Holden V6 Ute

Total Prize Value NZD$48,660.00 excl on-road costs

4.2 Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is accepted.

4.3 The prize being offered will be driven during the competition period by Visitec (NZ) Ltd representatives and/or its agencies and/or its associated companies from Monday 23rd February 2009 until Friday 31st May 2009. ("the Competition Period"). The prize offered will be the actual vehicle used for the competition complete with sign writing.

4.4 A condition of entry to the competition applies regarding post- competition use of the vehicle as an "on road" promotional tool. This post competition period will commence after announcement of the winner on June 15th 2009 until 15th December 2009. It is an expectation of the winner that the prize is to be driven on an ongoing basis during this period to maximise the exposure and further enhance both the Visitec Workwear brand and New Zealand's Hardest Worker concept.

4.5 The prize cannot be altered in any way by the winner between 15th June 2009 and 15th December 2009. Upon completion of this time period, the winner must then remove all the associated sign writing details regarding the promoter, its brands and the competition.

4.6 The winner will not engage in any unlawful or other improper misconduct bringing the promoter's name and/or reputation into disrepute at any time. The winner is liable for all costs and penalties associated with the use of the prize. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

4.7 Visitec (NZ) Limited and/or one of its representatives or their associated agencies or companies reserves the right to inspect the prize during the period between 15th June 2009 and 15th December 2009 to ensure the vehicle is kept in its promotional format. Visitec (NZ) Ltd reserves the right to amend or vary these terms and conditions at its sole discretion, orally or in writing for the purpose of this promotion.

4.8 The winner is responsible for all expenses relating to the prize including all appropriate insurances, petrol and all servicing costs. All appropriate insurances must be in place and copies provided to a nominated Visitec NZ representative prior to collection of the prize from Visitec (NZ) Ltd located at 34, Apollo Drive Mairangi Bay Auckland New Zealand. All risk and any liability is waived by Visitec (NZ) Limited upon collection of the prize.

4.9 It is a condition of the prize being awarded to the winner that a full insurance value of $48,660 be maintained until the vehicle comes under winner's full ownership. A copy of this insurance must be provided to the promoter showing currency before collection of the prize after 15th June 2009.

4.10 Registration of the prize remains in the name of Visitec (NZ) Ltd until 14th December 2009. After this date, the winner will be required to register the prize in their own name or nominated entity.

4.11 The prize is not transferable and cannot be redeemed for cash or other goods or services.

4.12 The winner will be notified by phone and also in writing via the contact details supplied on their entry form.

4.13 In participating in the promotion, the winners agree to participate and co-operate with the Promoter and the Sponsor as required in all editorial and promotional activities relating to the Competition, including but not limited to being interviewed, photographed and used in promotional material from time to time. The winner agrees to grant to the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.

4.14 The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.


5. HOW TO WIN

5.1 The winner will be those entries selected at random from a barrel draw by representatives appointed by the Promoter. All entries will be drawn at 10.00am NZ STANDARD TIME on Monday 15 June 2009 at Visitec (NZ) Ltd, 34 Apollo Drive, Mairangi Bay Auckland. The competition is a game of chance and the Promoter plays no part in determining the winner.

5.2 The winner will be notified by phone and also in writing via the contact details supplied on their entry form within (3) working days of determination of the winner. The winner will also be posted on the Visitec (NZ) website (www.workwear.co.nz).

5.3 The judges' decision is final and the Promoter will not enter into correspondence regarding the result.

5.4 Incomprehensible and illegible entries will be deemed invalid.

5.5 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize promoter's requirements including use of the vehicle as a promotional vehicle for a period after the official draw date.

5.6 The winner will not dispose of, encumber, alienate, sub-let, assign, permit any legal or equitable interest to be created in, part with possession or control of, conceal or otherwise deal with the prize or the Promoter's interest therein until after 15th December 2009.

5.7 The winner is liable for ongoing payment of all servicing costs, traffic fines, other penalties and other such payments incurred in connection with the prize from the announcement date of 15th June 2009.

5.8 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter, as the case may be, in their absolute discretion.

5.9 If the winner does not collect their prize within a one (1) month period, the promoter reserves the right to re-draw the prize. The re-draw will take place on Monday 20th July 2009 at Visitec (NZ) Limited premises located at 34 Apollo Drive, Mairangi Bay Auckland at 10AM.


6. NO LIABILITY

6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions.

6.2 Visitec (NZ) Limited, any associated retail store and or their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur.

6.3 Visitec (NZ) Limited, any associated retail store and or their associated agencies and companies reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of this promotion.

6.4 Visitec (NZ) Ltd, any associated retail store and or their associated agencies and companies reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

6.5 Visitec (NZ) Ltd, any associated retail store and or their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.

6.6 If for any reason this competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition subject to written instructions from State Regulatory bodies.


7. PROMOTER'S DETAILS

7.1 The Promoter is Visitec (NZ) Limited of 34 Apollo Drive, Mairangi Bay Auckland, New Zealand

7.2 All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose of collection of entrants' personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies and promotional partners and may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants' personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner's name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
